One of the marks of a good attorney is the willingness and ability to pursue a case all the way through trial.  Our lawyers have that willingness and ability as evidenced by the following trial successes:

Our client purchased a new Mercedes Benz AMG, which manifested a vibration in the steering wheel from the date of purchase. Our client returned the vehicle for repairs on six different occasions. At the last repair attempt, the vehicle was almost completely repaired. Prior to filing the lawsuit, our client tried to settle the matter for a set of new tires. Mercedes-Benz refused. McCoy, Turnage & Robertson was associated into the case by another California lemon law attorney approximately 30 days before trial.  We argued that Mercedes Benz had violated the Lemon Law by refusing to repurchase the vehicle when requested to do so by our client after the fourth repair attempt. The court awarded our client a full refund and a $15,000 civil penalty for Mercedes-Benz's wilful conduct. The court also awarded attorneys' fees and costs.

Our client purchased a new Ford F350 which was subsequently modified with an 8" lift kit at a company recommended by the selling dealership. The dealership had told our client that the vehicle would still be covered under warranty after the modification. After three repair attempts to the transmission, it failed completely. Ford and its authorized dealership refused to repair the transmission stating that the defect was caused by the lift kit. At trial, we argued that Ford had violated the Lemon Law when it refused to repair the transmission. The jury awarded a full refund to our client and a $35,000 civil penalty. The court also awarded attorneys' fees and costs.

Our client was sold a used truck with over-sized, aftermarket tires that had been installed by the selling dealership. Our client agreed to purchase the truck in large part because of the special tires. When our client drove the vehicle home from the dealership, however, he noticed that the tires rubbed on the wheel wells. He tried to return the vehicle to the dealership, but the dealership refused to help him. The court awarded our client a full refund. Attorneys' fees and costs were settled out of court.

Our client was sold a used Mercedes Benz. At the time of sale, he signed a statement acknowledging that the dealership had told him that the vehicle had been in an accident. He also signed an "as is" agreement. Three months later, our client learned that the vehicle had not only been in an accident, but had a "salvage title." Investigation by our expert witness revealed that the vehicle was dangerous to drive. The court awarded a full refund and $20,000 in punitive damages. The court also awarded attorneys' fees and costs. After the verdict, the dealership went out of business and its owner filed for bankruptcy. Our office then made a successful claim on the dealership's bond, which resulted in a partial payment to our client despite the  claimed insolvency of the dealership.  Additional collection efforts are pending.
